Custom Personalization and Customer-Submitted Content Terms
These Custom Personalization and Customer-Submitted Content Terms ("Custom Personalization Terms") apply to all personalized, customized, engraved, printed, or otherwise customer-directed products and services offered by Church Hill Classics ("Church Hill Classics," "CHC," "we," "us," or "our"), including, without limitation, personalized plates, engraved plates, Print on Mat products, and products incorporating customer-provided text, photographs, artwork, graphics, or other materials.
These Custom Personalization Terms supplement and are incorporated into Church Hill Classics' Terms and Conditions. 1. Personalized Content
For purposes of these Custom Personalization Terms, "Personalized Content" means any text, name, image, photograph, artwork, graphic, logo, trademark, design, file, or other material that you submit, enter, select, transmit, or otherwise provide to Church Hill Classics for inclusion in or use in connection with a personalized product.
Personalized Content includes, without limitation:
- Names, initials, signatures, dates, titles, quotations, and personal messages;
- School, college, university, organization, employer, company, association, military unit, club, or team names;
- Event names, awards, achievements, commemorative language, and other custom text;
- Logos, trademarks, service marks, insignia, seals, mascots, graphics, illustrations, artwork, and designs;

2. CHC-Licensed Marks and Content
Church Hill Classics separately licenses certain university names, seals, logos, trademarks, insignia, and other intellectual property from universities, colleges, organizations, licensors, and other rights holders ("CHC-Licensed Content").
- CHC-Licensed Content offered by Church Hill Classics as part of an authorized product is reproduced by Church Hill Classics pursuant to the applicable license or authorization and is not considered customer-submitted Personalized Content solely because you select that authorized option during the ordering process.
Nothing in these Custom Personalization Terms grants you any ownership, license, or independent right to copy, reproduce, download, extract, alter, distribute, sell, or otherwise use CHC-Licensed Content outside the product and manner in which Church Hill Classics makes it available.
If you independently type, submit, or otherwise provide a school name, logo, seal, trademark, insignia, mascot, or other protected material that is not being supplied by Church Hill Classics as authorized CHC-Licensed Content, that material constitutes Personalized Content and is subject to all of your representations, warranties, and obligations under these Custom Personalization Terms.
3. Your Representations and Warranties
By submitting Personalized Content, you represent and warrant that:
Ownership and Permission. You own the Personalized Content or have obtained all rights, licenses, permissions, releases, consents, and authorizations necessary for you to use the Personalized Content and to authorize Church Hill Classics to reproduce, process, manufacture, and otherwise use it as necessary to fulfill your order.

Your Personalized Content and Church Hill Classics' reproduction and use of that Personalized Content as authorized by you will not infringe, misappropriate, or otherwise violate any copyright, trademark, service mark, trade name, patent, trade secret, design right, right of publicity, right of privacy, contractual right, proprietary right, or other right of any person or entity.
Names, Images, and Likenesses. If your Personalized Content contains the name, photograph, image, likeness, signature, or other identifying characteristic of another person, you have obtained all permissions and releases legally necessary to authorize the requested use. Where consent from a parent, guardian, representative, estate, or other authorized person is legally required, you represent that you have obtained that consent.
Organizations and Third Parties. If you submit Personalized Content on behalf of a company, school, university, organization, team, association, military organization, employer, or other third party, you represent and warrant that you are authorized to submit the Personalized Content and authorize its reproduction.

Accuracy. All spelling, wording, capitalization, names, dates, numbers, titles, images, and other information you submit are accurate and are presented as you intend them to appear.
No False Affiliation. Your Personalized Content does not falsely state or imply sponsorship, endorsement, approval, certification, affiliation, authorization, or association with any person, business, school, university, organization, team, government entity, military organization, rights holder, or other third party.
These representations and warranties apply regardless of whether Personalized Content was created by you, obtained from another person or source, downloaded from the internet, generated or modified using artificial intelligence or other software, purchased from a third party, or previously used elsewhere.
If you are uncertain whether you have the necessary rights or permissions to use any material, do not submit that material for personalization.
4. Limited License to Church Hill Classics
You retain whatever ownership rights you lawfully hold in your Personalized Content.
By submitting Personalized Content, you grant Church Hill Classics and its employees, contractors, suppliers, service providers, and production partners a nonexclusive, royalty-free license to reproduce, process, transmit, resize, crop, format, convert, position, engrave, print, manufacture, package, and otherwise technically modify the Personalized Content solely as reasonably necessary to:

- Comply with applicable law or legal process.
Submitting Personalized Content does not give Church Hill Classics the right to use your Personalized Content in advertising, marketing, promotional materials, or unrelated commercial products unless you separately provide permission for that use.
5. Customer Responsibility and Final Approval
You are solely responsible for all Personalized Content you submit and for confirming that you have the legal right to request its reproduction.
Church Hill Classics does not undertake to independently investigate or verify the ownership, copyright status, trademark status, licensing status, authorization, legality, accuracy, or permitted use of every item of Personalized Content submitted by customers.
Any review, assistance, formatting adjustment, production adjustment, acceptance, approval, or failure by Church Hill Classics to reject Personalized Content does not constitute legal review or confirmation that the Personalized Content is authorized, lawful, or non-infringing and does not relieve you of your responsibilities under these Custom Personalization Terms.
Where Church Hill Classics provides a personalization preview, proof, or other opportunity for review, your approval is final as to the content shown.
Except where an error is caused by Church Hill Classics, CHC is not responsible for customer-submitted spelling errors, incorrect names, incorrect dates, incorrect numbers, punctuation, capitalization, image selection, wording, formatting choices, placement choices, or other errors contained in Personalized Content approved or submitted by you.

- Is otherwise inappropriate for production or inconsistent with Church Hill Classics' policies, contractual obligations, licensing requirements, or business standards.
7. Right to Review, Request Documentation, Refuse, Suspend, or Cancel
Church Hill Classics reserves the right, but does not assume an obligation, to review Personalized Content.
At any time before fulfillment, Church Hill Classics may request documentation reasonably demonstrating your ownership, authorization, license, permission, release, or other right to use Personalized Content.
Such documentation may include written authorization from a copyright owner, trademark owner, university, organization, photographer, artist, employer, team, league, licensor, depicted individual, or other applicable rights holder.
Failure or refusal to provide requested documentation may result in the personalization request or order being suspended or canceled.
Church Hill Classics may, in its sole discretion and to the fullest extent permitted by law, reject, pause, suspend, require modification of, or cancel a personalization request if CHC believes the Personalized Content:
- May violate these Custom Personalization Terms;

Any refund or other remedy associated with a rejected or canceled personalization request will be handled in accordance with applicable law and Church Hill Classics' applicable policies.
8. Intellectual Property and Other Claims
If Church Hill Classics receives a complaint, demand, cease-and-desist request, infringement notice, licensing objection, court order, governmental request, or other claim involving Personalized Content, CHC may take any action it reasonably considers appropriate, including placing an order on hold, refusing production, stopping shipment, canceling an order, preserving relevant records, requesting additional information, or communicating with the customer and/or claimant.
To the extent permitted by applicable law and consistent with Church Hill Classics' Privacy Policy, CHC may provide information reasonably necessary to investigate, respond to, resolve, or comply with a claim, legal obligation, subpoena, court order, governmental request, or enforcement proceeding.
Church Hill Classics' receipt of a claim does not constitute an admission that the claim is valid.
9. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Church Hill Classics and its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors, suppliers, service providers, successors, and assigns from and against any and all third-party claims, demands, notices, actions, proceedings, liabilities, damages, judgments, settlements, penalties, losses, costs, and expenses, including reasonable attorneys' fees and legal costs, arising out of or relating to:
- Personalized Content submitted by you;
