Official Contest Rules & Guidelines
Official Rules. No purchase necessary. Open only to legal residents (including APO/FPO addresses) of the United States (excluding Puerto Rico), who are 18 years of age or older as of date of entry. Void where prohibited by law.
• How to Enter Contest: Visit beginning June 15, 12:00 AM EST through July 31, 11:59 PM EST. You may enter by submitting the online entry form with your full name, phone number, address, e-mail address, brief description of your photo, how you found out about the contest, and then attaching your photo.  By entering your photo with this form you are agreeing to these Official Rules and warranting that your entry complies with all requirements set out in these Official Rules:
• You must submit a photo depicting “Proud to be an American.”  The photo entry must:
o Be in color or black and white (jpeg or gif files) no larger than 3 MB in file size;
o Be property of the entrant and must be a non-professional photograph;
o You must have the permission of all persons appearing in your photo for you to submit your photo, and may need a Release from each person depicted in photo (at Church Hill Classics (Sponsor's) request).  If you do not have the permission of all persons appearing in your photo, please do not make a submission; 
o Be e-mailed in accordance with specifications set forth at the web site. Enter as often as you like, but each entry must include a photo and must be unique and be the sole, original work of the entrant. Duplicate submissions will automatically be disqualified
 
• General Entry Information: Entries must be received no later then the contest ending date and time. Entrants and Winners acknowledge and agree that by entering the Contest, entrant grants Sponsors the non-exclusive, royalty-free, irrevocable rights to use, crop, reproduce, promote, publish, and display.  Entries deemed lewd or inappropriate, at Sponsor’s sole discretion will be disqualified.  Sponsor also has the right to use the entries and excerpts of the entries in any advertising and promotional materials (visual, sound, print and/or electronic form), including posting entries on its website and non-affiliated web sites. Entrants may not copy or otherwise plagiarize the entry from any source. Any entry or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials or trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the entrant. Entrant represents and warrants that: i) all rights to the entry belong to him/her and the entry does not and shall not infringe on any copyright or any other third party right nor violate any applicable law or regulation, (ii) he/she has the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright and other related rights to the entry, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity, (iii) he/she hereby hold Sponsor harmless from and against any third party claim arising from use of the entry and he/she waives any right to inspect or approve uses of the entry or to be compensated for any such uses. Therefore, clothing worn in the photo/video should not contain any visible logos, drawings, cartoons, phrases trademarks, or other third party materials.
• Eligibility: This contest is open only to legal residents (including APO/FPO addresses) of the United States of America (excluding Puerto Rico), who are 18 years of age or older as of the date of entry. Void in Puerto Rico and where prohibited by law. All United States federal, state, and local laws and regulations apply.
• Judging: All eligible entries received will be judged, to determine one Grand Prize winner and one runner up. The Prize winners will be judged on or about one week after the contest’s ending date from among all eligible entries. Judging will be conducted by a panel of judges at Church Hill Classics, whose decisions are final on all matters relating to this Contest, based on the criteria listed below. Submissions that do not contain any eligible photo or are considered inappropriate are not eligible. All entries must be the sole, original work of the entrant and must not infringe on any third party rights. Judges may disqualify previously published submissions or those that have won previous awards or competitions. Incomplete entries will not be considered for judging.  Each entry must include an entire completed entry form and photo.  No information regarding entries or judging, other then as otherwise set forth in the Official Rules, will be disclosed.  
• Prize(s) and Approximate Retail Value ("ARV"): GRAND PRIZE (One): The grand prize winner will receive $300 in U.S. Savings Bonds and a Church Hill Classics’ frame for a photo up to 11” x 14”.  One runner up will win $150 in U.S. Savings Bonds and a Church Hill Classics’ frame for a photo up to 8” x 10”.  Prize winners will be notified by mail/e-mail at the address and/or e-mail address used at the time of entry. The Contest is expressively contingent upon a sufficient number of eligible entries being received by the Sponsor. In the event there are no eligible entries, the Prize will not be awarded. Prizes are not transferable; no substitutions or cash equivalents are allowed except by the Sponsor who reserves the right to award a prize of equal or greater value. Sponsor assumes no responsibility or liability, for damages, losses or injury resulting from acceptance or use of the prize. Taxes related to the prizes, if applicable, are the sole responsibility of the individual winners.  Prizes must be claimed within 30 days of notification.  If not claimed by this date, the prizes will be forfeited.  All claims thereto following this date will be null and void.
• General Rules: Unless otherwise prohibited by law, submission of entries constitutes permission to use the entrant's name, entry submission including photo, likeness and biographical information for advertising and publicity purposes, without further compensation. Grand Prize winner(s) will be required to sign and return an Affidavit of Eligibility, Liability Release, Assignment of Rights and where legal, a Publicity Release within ten (10) days of notification attempt or prize will be forfeited and an alternate will be determined. Return of any prize or prize notification as undeliverable may result in disqualification and alternate determination. All entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, on line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest or Web Site; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWES AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor and its agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost of unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest which may be limit the ability to participate or by any human error which may occur in the processing of the submissions in this Contest. Sponsor reserves the right to cancel the Contest if it becomes technically corrupted, and award the Prizes from eligible entries received prior to cancellations. Sponsor reserves the right to cancel or suspend the contest should any cause beyond the control of the Sponsor affect the administration, security, fairness, integrity or proper operation of the contest, or for any other reason it deems appropriate, at its sole and absolute discretion.  Entrants agree to be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding. 
• Winner(s): We will announce the winners on the website approximately one (1) week after the end of the contest.  Each winner must agree in writing that his or her name, likeness, city, winning photo and negative may be used by Church Hill Classics for promotional and publication purposes without additional compensation.  Prior to receiving prizes, each winner will be required to sign a release provided by Church Hill Classics to this effect and obtain a release or permission from anyone with proprietary rights in the winning photograph (such as artwork, trademarks or a person’s likeness).  Refusal or inability to provide such releases or permissions will result in entrant’s disqualification in this photo contest, and any prizes will be forfeited.  
• Limitation of Liability: Neither Church Hill Classics, their agents, employees, parents, subsidiaries, or affiliated companies, as well as their advertising and promotion agencies shall have any liability for any indirect, special, punitive or consequential damages including, without limitation, loss of opportunity or goodwill. In all events, the sole maximum liability of Sponsor and its affiliates shall be limited to the any of the prize(s) set forth herein.
• Choice of Law: Except where prohibited by law, all issues and questions concerning the constitution, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and the Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of Connecticut in the U.S., without giving effect to any choice of law or conflict of law rules (whether of the State of Connecticut, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Connecticut in the U.S.
